The individual’s criminal record is divided into several sections, which can help you find specific information you may be looking for. Here is a summary of what a citizen searching these records can find in each section.

Case Summary: Here, you can find general identifying information about a criminal record, including the defendant’s name, case type and the date it was filed. You can also view the county location for the criminal case and the judge who oversaw the matter.

Party Information: This section will provide you with the city and state location of the defendant, as well as the prosecutor and attorney representing the defendant and their contact information.

Charge Information: In this section, you can view a list of all criminal charges, the applicable statute, as well as what level of misdemeanor or felony the charge is considered. You can also view the date each particular charge was filed.

Events & Orders of the Court: The events listed in this section are the major court hearings that occurred in a particular matter. You can view information on the plea, disposition of the case and judgment issued. A requester can receive a statewide background check through the North Dakota Bureau of Criminal Investigations (BCI).7 The North Dakota BCI is the record’s custodian for all criminal history information throughout the state.

To request a criminal record check, you can do so by either one’s name or fingerprints. A fingerprint-based search is more accurate as there are limitations to conducting a name-based search. How To Obtain Ward County North Dakota Vital Records (Marriage, Divorce, Birth & Death)

It’s inevitable that, at some point, a person will need to access vital records. Vital records are government-issued documents of major events in one’s life (marriages, divorces, births and deaths). Vital records can be used personally and professionally.

People may want access to vital records for personal reasons, to see where someone was born or to check if someone is married. Oftentimes, people look up vital records as part of a genealogy search for their family.

Professionally, you may be required to submit a certified copy of a vital record to a business or government agency. Certified copies may be required if you are trying to claim certain benefits, such as being added to a policyholder’s health insurance policy or making a claim as a beneficiary. Government agencies may request a certified copy of a vital record for name changes, passports and other matters.

Vital records come with various rules based on the type of record you are requesting (information or certified) and your relationship to the individual listed on the record. Below is information on how to access Ward County vital records and any restrictions you may encounter.

Request Marriage & Divorce Records via the Ward County Recorder’s Office or North Dakota’s Court Inquiry Search Tool

Ward County Divorce records can be searched by using the Court Record Inquiry Search Tool provided by the North Dakota Court System. To perform a divorce record search, select Ward County as your location and click on “Civil, Family & Probate Case Records.” On the next page, select “Divorce” under case types.

Now, you are ready to enter your search criteria. You can search by case, party name, attorney or date filed. If searching by name, you can set a filing date range and search open, closed or all cases. A “Soundex” option allows you to type in the person’s name phonetically if you are not sure how it is spelled.

After entering your information, the search results will provide you with a list with the case number, case caption, file date and status. Click on the case number to get divorce record details.

The online divorce record will contain basic party information, including the attorneys involved and where the divorce case was filed. You can also view the disposition of the case (when the divorce decree was entered) as well as a chronological list of all events that occurred during the divorce case. Lastly, you can view court filing financial information and whether there are any outstanding balances.

Note: While copies of other types of vital records can be requested from North Dakota State Agencies, marriage and divorce records can only be obtained from the County Recorder or Clerk it was issued.

Acquire Ward County Birth & Death Information via the North Dakota Department of Health or the State Historical Society

Birth certificates and death certificates cannot be obtained at the county level and must be requested through the North Dakota Department of Health. Also, requesting a certified copy of either of these records is restricted to a small group of people.

For a certificate of birth, only the individual listed on the record or their parents can request a copy.

Any other individual must have a court order listing the registrant’s name and date of birth or legal documentation that lists you as an authorized representative of that individual. Access is expanded to other immediate relatives, such as a grandparent or grandchild, if the registrant listed on the birth record is deceased.

For a certificate of death, only a relative, authorized representative, or funeral director can request a certified copy. Beyond that, a requester must have a court order to receive a copy of a death record. An information copy of a death record can be issued to the general public but does not include the cause of death of the decedent.

A birth or death record can be requested online from the North Dakota Department of Health Vital Records Division, by mail or in person.17 To make a request by mail, you can complete either the Birth Request Application or the Death Request Application. For in-person requests, call them at 701-328-2360 to schedule an appointment and bring in your form, fee and identification at the designated time. Certified birth records cost $15.00, and death records cost $15.00 for the first copy and $10.00 for each additional copy.

While it’s limited to birth records 125 years or older and death records over a year older, an online option for looking up these records is the State Historical Society of North Dakota’s public records repository. Birth records can be searched by the registrant or their parent’s name and can be narrowed down to Ward County and a specific birth date range.

You can search Ward County public records to access property ownership and tax information through multiple online search tools provided by the Director of Tax Equalization.

Once you perform your search, you can get a basic summary of the piece of real property, such as the legal description, zoning, land use and parcel number. This search tool will also provide the property’s value for the current and past several years. Finally, you can get specific information about the building, such as occupancy, size, and the year it was built.

Their second tool is a public index of property sales. There are numerous options you can include as part of your search criteria. A person can search by sales date or amount range, style (e.g., one-story frame) and square footage of specific rooms in the house. You can also search by tax district or subdivision.

Public records in Ward County are invaluable and a powerful tool. Because of this, it’s imperative that these records are used in a responsible and ethical manner.

Personal Use: Personal use is an informational search to learn more about someone with no specific legal or business purpose. Think of it as an informal and private way to understand more about someone in your life (e.g., friend, neighbor, co-worker).

Your rights when it comes to personal use is the ability to search a person without consent. In addition, you can submit a FOIA request for any public records that are not easy to access. Government agencies must be responsive to your inquiry and provide the requested documents if not subject to any exemptions.

Your responsibilities include avoiding the use of records searched for personal reasons for a professional purpose. Your other duty is to ensure that your personal use of public records does not involve any criminal activity (e.g., stalking, harassment etc.).

Professional Use: Professional use is a search conducted for a business or legal reason. Sometimes, they are done voluntarily (e.g., employment or rental application), and other times, they are required by state or federal law (e.g., firearm license, security clearance, etc.).

There are various laws and regulatory agencies that govern the professional use of public records. Below are some of the more notable legal obligations for professional use.

Before you perform a search or request a background check report, make sure to get the person’s consent. If you decide to take adverse action against a person after viewing their record, make sure they are properly notified. If a person fails to take either action, they can be reported to the Federal Trade Commission (FTC).22

While you can take adverse action based on public records, you cannot discriminate against a person. If you discriminate against a person from a protected class or because of a criminal record, a person may file a claim with the Equal Employment Opportunity Commission (EEOC).23

If you check a person’s consumer record for creditworthiness, you must abide by the requirements of the Fair Credit Reporting Act (FCRA). The FCRA gives a person the right to ask what’s in their file and dispute the accuracy of information.
